MyScan — Terms of Use

These Terms govern your use of the MyScan biometric scanning module within the Nation Clinic digital platform.

MyScan is operated by:

By using MyScan, you agree to these Terms. If you do not agree, you must not use the service.

1.What MyScan Provides

MyScan enables you to perform mobile, camera-based biometric scans using your device’s front-facing camera and an embedded on-device biometric processing engine. MyScan provides estimated physiological indicators such as:

  • Heart rate
  • Heart rate variability
  • Respiratory rate
  • Oxygen saturation (SpO₂)
  • Blood pressure estimates
  • Stress index
  • BMI (derived from height/weight)
  • Confidence and quality metrics

Note: MyScan is not a diagnostic tool and does not provide medical advice. Any medical interpretation or action will be carried out by authorised Nation Clinic clinicians.

2.Eligibility

To use MyScan, you must:

  • Have an active Nation Clinic patient account
  • Be at least 13 years old
  • Use the service only for lawful and personal purposes
  • Provide accurate profile information to support correct measurement

If you are under the age of majority in your jurisdiction, you must have parental or guardian consent.

3.Biometric Consent

Before you can perform your first scan, you must provide explicit biometric consent.

By giving consent, you confirm that you understand and agree to:

  • Activation of your device’s front-facing camera
  • Processing of facial signals into physiological measurements
  • Transmission of structured biometric results to Nation Clinic systems
  • Storage of scan results within your clinical record
  • Automatic triage or escalation when values exceed clinical thresholds

Consent remains in effect until you withdraw it. Withdrawing consent disables MyScan but does not remove previously stored medical records.

4.How MyScan Works

  1. You are guided through visual instructions for positioning and stability.
  2. Your device’s on-device biometric engine analyses your facial signal patterns.
  3. No video or images are stored.
  4. The engine produces structured numerical biometric results.
  5. Results are validated and sent to the Nation Clinic back-end services.
  6. If necessary, automatic clinical triggers may be generated.
  7. Results are stored in your MyRecords medical record.
  8. You are shown a summary of the results.

If results fall outside defined thresholds, follow-up may be initiated through clinician review or automated questionnaires.

5.Your Responsibilities

When using MyScan, you agree to:

  • Provide accurate personal data (age, height, weight) when requested
  • Follow the instructions shown during the scan
  • Not misuse the system, attempt to tamper with results, or interfere with the scanning flow
  • Not use MyScan for any unlawful, harmful, or deceptive purpose
  • Not attempt to reverse-engineer, copy, or modify the biometric engine or MyScan software
  • Use the service only for your own personal health monitoring
  • Notify Nation Clinic if you believe your account has been accessed without permission

You are responsible for the security of your device.

6.Accuracy and Limitations

MyScan aims to provide accurate, high-quality physiological indicators. However:

  • Results may be affected by lighting, movement, device performance, or environmental conditions
  • MyScan does not guarantee accuracy
  • MyScan does not replace professional medical assessment
  • You should not make health decisions solely based on MyScan results
  • If you experience symptoms or concerns, you must seek medical attention

7.Clinical Escalation

MyScan includes automated threshold logic approved by Nation Clinic’s clinical governance team.

Depending on your results:

  • No action may be required (normal range)
  • You may be advised to re-scan or monitor again (borderline range)
  • A clinician may review your results (flagged range)
  • You may receive automated follow-up questions or prompts

Clinical escalation decisions are made by Nation Clinic clinicians according to internal governance frameworks.

8.Data Handling

Your data is handled according to the MyScan Privacy Policy, which forms part of these Terms.

Key principles:

  • No images or raw camera footage are stored or transmitted
  • Biometric processing occurs on your device
  • Only structured metrics are transmitted to Nation Clinic systems
  • Results are securely stored in your medical record
  • Logs are maintained for safety, audit, and quality assurance
  • Data is never sold or used for advertising

9.Service Availability

Nation Clinic aims to provide consistent availability of MyScan, but does not guarantee:

  • Uninterrupted access
  • Error-free performance
  • Compatibility with all devices or operating system versions

Maintenance, technical issues, or updates may temporarily interrupt service. Nation Clinic may modify, suspend, or discontinue MyScan at any time.

10.Suspension or Termination of Access

Nation Clinic may suspend or terminate your access to MyScan if:

  • You violate these Terms
  • You misuse the biometric engine or system
  • Your account shows suspicious or unauthorised activity
  • Continued access presents security or safety risks
  • Required consent is withdrawn

Termination of access does not affect medical record retention obligations.

11.Intellectual Property

All content, software, interfaces, workflows, and biometric processing logic within MyScan are the property of Nation Clinic Ltd or its licensors.

You receive a personal, non-transferable, revocable licence to use MyScan as part of the Nation Clinic platform. You may not:

  • Copy
  • Modify
  • Reverse-engineer
  • Distribute
  • Sell
  • Create derivative works from any part of MyScan

12.Limitation of Liability

To the fullest extent permitted by law:

  • MyScan is provided “as is”
  • Nation Clinic makes no warranties regarding accuracy or reliability
  • Nation Clinic is not responsible for decisions made based on scan results
  • Nation Clinic is not liable for indirect, incidental, or consequential damages
  • Nation Clinic is not liable for loss caused by device issues, network issues, or user error

Nothing in this section limits any rights you may have under applicable health or consumer laws.

13.Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14.Changes to These Terms

Nation Clinic may update these Terms to reflect:

  • Improvements to MyScan
  • Updates to clinical governance
  • Regulatory or legal requirements
  • System architecture changes

The “Last Updated” date will be updated accordingly.
